Ngoron said Trump was fined $ 10,000 a day in April for failing to comply with the subpoena. It stopped accumulating on Friday when the former president and his lawyers submitted a new affidavit detailing the steps taken to find documents related to Attorney General Leticia James’ investigation..

Trump said in his May 6 affidavit that he had no relevant documents.

Engoron cited Trump’s claims that he has not communicated digitally since 2010 in his Twitter posts and current posts on the social network Truth Social, the social network he founded.

“We all know he’s using electronic communication – he has 80 million people on his Twitter account,” Ngoron said. “A sentence must be true. That sentence is not correct.”

Trump’s lawyer Michael Madayo said the statement was not intended to indicate that Trump had not posted it on social media. Alina Habba, another of Trump’s lawyers, said Trump did not use direct messages on Twitter and that his tweets were not relevant to the investigation.

The judge allowed Trump until May 20 to comply with additional conditions, or he could reinstate the negligence order and reinstate the fine earlier.
