– In a fierce move to claim the trademark of one of his most famous works, the British street artist Banksy, generally known for floating in obscurity, opened a shop last autumn hoping that EU judges would favor him. Each Free, The European Union’s Electronic Property Office ruled this week that Banksy’s trademark for his “Love is in the Air” artwork (“Flower Thrower”) in 2014 was invalid and that the greeting card company’s Full Color Black ‘challenge was invalid. FCB, which used the artwork on their cards, argued that Banksy was not using the art itself for any commercial or branding purposes and therefore it was a fair game.

Trademark lawyer Aaron Wood, who represented Full Color Black in the case, called the decision “disastrous” for the bank. “He needs to consider whether any of the trademarks for his artwork are really valid,” Wood told The Independent.
