The court overturned the disputed Ryanair clauses

The low-cost airline wanted to prevent passengers from making claims for compensation through online portals. Now the Irish had suffered a setback.

Bad Homberg. The Frankfurt District Court overturned the terms of the airline, Ryanair, which barred passengers from submitting their compensation claims to Internet portals.

The court found that various points were illegal, which adversely affected consumers. After the delay or cancellation of the flight, the customer should be able to decide for himself whether to pursue his claims or to pay them to a third party.

According to the ruling, RyanAir had secured long-term processing time in terms and conditions, and was only interested in accepting the rights of natural persons and making direct payments to passengers. All conditions were violated by the Passenger Rights Ordinance, however the Frankfurt judges found. For customers, Ryanair must acknowledge that routing through Passenger Right portals is a simple and uncomplicated way to implement their needs. The company also could not rely on Irish law with a complicated clause.

The Frankfurt Competition Center won the verdict, which had already reached a similar, now legally binding verdict in the Berlin Regional Court against the Hungarian low-cost airline Wis Air. However, the Frankfurt Decree (Az. 2-03 O 527/19) is not yet legally binding. A spokesman for headquarters said it would approach federal court if necessary. (DPA)
